1. ABOUT THIS PORTAL
These Terms and Conditions govern the use of the AV MOTORS AUTOMOTIVE online portal and the ECU file services available through it.
By creating an account, adding funds, uploading a file or ordering a service, the customer confirms that they have read, understood and accepted these Terms and Conditions.
2. ACCOUNTS
Customers are responsible for providing accurate information and for keeping their account credentials secure.
All activity performed through a customer account is considered to have been authorised by the account holder.
3. ECU FILE SERVICES
AV MOTORS AUTOMOTIVE provides ECU/TCU calibration, file processing and related automotive software services.
Available services and compatibility may vary depending on vehicle, ECU/TCU type, software version and the quality or completeness of the uploaded file.
Submitting a file does not guarantee that every requested modification can be completed.
4. CUSTOMER RESPONSIBILITY
The customer is responsible for:
- Uploading the correct and complete original ECU/TCU file.
- Providing accurate vehicle and ECU/TCU information.
- Creating and securely storing a backup of the original file.
- Using appropriate professional reading and programming equipment.
- Verifying that the vehicle is mechanically and electrically suitable before programming.
- Ensuring that all requested modifications are permitted by applicable laws and regulations.
The customer must have the legal right and authority to modify the vehicle or ECU/TCU data submitted through the portal.
5. EMISSIONS AND REGULATORY COMPLIANCE
Certain services may affect emissions-related or other regulated vehicle systems.
Such services are provided only for applications where they are legally permitted, including, where applicable, motorsport, competition, off-road, export, testing or non-road applications.
The customer is solely responsible for determining whether a requested modification is legal for the intended vehicle and jurisdiction.
AV MOTORS AUTOMOTIVE does not authorise the use of modified files in violation of applicable laws or regulations.
6. PRICES AND WALLET BALANCE
Prices displayed in the portal at the time an order is submitted are the applicable customer prices.
Customers may be required to maintain sufficient wallet balance before requesting a service.
Wallet top-ups, bonuses or promotional credits may be subject to additional conditions displayed in the portal.
7. PROCESSING AND DELIVERY
Processing times are estimates and may vary depending on ECU/TCU type, file complexity, requested services, technical issues and service availability.
Completed files are delivered through the customer portal or other available delivery method.
No specific completion time is guaranteed unless explicitly agreed in writing.
8. NO SOLUTION AND REFUNDS
If a requested service cannot be completed and the request is classified as "No Solution", the applicable amount may be returned to the customer's portal wallet according to the platform's refund procedure.
A successfully processed and delivered digital file is generally considered a completed service.
Refund requests concerning completed files will be reviewed individually, particularly where a verified technical problem exists.
9. FILE VERIFICATION AND TECHNICAL SUPPORT
Customers should report any suspected issue with a processed file before making additional modifications to that file.
When requesting technical support, the customer may be required to provide the original file, processed file, diagnostic trouble codes, ECU identification information and relevant diagnostic logs.
AV MOTORS AUTOMOTIVE may provide revisions where technically appropriate.
10. VEHICLE CONDITION
ECU/TCU calibration cannot repair mechanical, electrical or diagnostic faults.
Before using a modified file, the customer is responsible for ensuring that the vehicle, engine, transmission and associated systems are in suitable operating condition.
Existing faults may affect the operation or results of a calibration.
11. LIMITATION OF LIABILITY
Automotive ECU/TCU programming involves inherent technical risks.
To the maximum extent permitted by applicable law, AV MOTORS AUTOMOTIVE is not responsible for damage resulting from incorrect reading or writing procedures, unstable power supply, unsuitable programming equipment, incorrect customer information, pre-existing vehicle faults, improper installation or use of a file outside its intended application.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
12. INTELLECTUAL PROPERTY
Files, calibrations and other materials supplied through the portal are provided for the customer's authorised use.
Customers may not resell, redistribute, publish, reverse engineer for redistribution, or commercially reproduce supplied files except where expressly authorised.
13. MISUSE OF THE SERVICE
AV MOTORS AUTOMOTIVE reserves the right to refuse, suspend or terminate service where there is suspected fraud, abusive behaviour, unauthorised use, unlawful activity or misuse of the platform.
14. SERVICE AVAILABILITY
The portal or individual services may occasionally be unavailable because of maintenance, updates, technical failures or circumstances outside our reasonable control.
Continuous or uninterrupted availability is not guaranteed.
15. CHANGES TO THESE TERMS
These Terms and Conditions may be updated when necessary.
The version displayed in the portal at the relevant time will apply, subject to any mandatory rights provided by applicable law.
